Amana and Goodman Air Conditioners Alleged To Have Violated Consumer Warranties in Class Action Lawsuit Filed by Audet and Partners, LLP

A new class action lawsuit filed in Florida alleges that air conditioner units manufactured and sold by Amana and Goodman since 2008 may have been sold with defective evaporator coils in breach of product warranties.

A new class action lawsuit filed in Florida on May 7, 2013, alleges that Goodman and Amana manufactured and sold air conditioner units since 2008 that failed to conform to reasonable consumer expectations based on express product warranties. The Complaint filed in the lawsuit, Helms v. Goodman Global, Inc., et al, United States District Court, Middle District of Florida, Case No. 8:13 CV1213T17TBM*, alleges that central air conditioning units sold during this time contain defective evaporator coils prone to premature rupture.

The central air conditioning units manufactured and sold during this period by Goodman Manufacturing Company, the second largest manufacturer of air conditioning units in the United States, allegedly contain defective evaporator coils that may have caused units to rupture and leak Freon, often rendering the units unable to cool air. The lawsuit contains allegations that the company knowingly sold defective air conditioning units, hid the problem from consumers, and unfairly denied warranties claims for the defective products*.

The lead plaintiff in this class action lawsuit, Ms. Janet Helms, alleges that numerous failures of her Amana air conditioning unit required out-of-pocket costs exceeding $9,000 for repairs and ultimate replacement of her unit*.

Attorney William Audet whose law firm, Audet and Partners, LLP, filed the lawsuit, commented on the allegations raised in the class action complaint: "Information we continue to gather from purchasers of these units suggests a potential likelihood that the manufacturers knew, or should have known, that the units would fail to perform as warranted. We understand that while few product are failsafe, the rate at which these units may have faltered after very limited use raises the specter of warranty breach by the manufacturer in many of these cases."
